General
Thank you for choosing Azure.  All bookings are subject to acceptance of the terms and conditions stipulated below.  “Azure” refers to the penthouse and its owner, management and staff.

Rates
Rental rates quoted by Azure are on a per-day basis in US dollars.  Rates include:
  • services of a representative – usually our hospitality executive Khun Oh – to escort guests from the airport or pier on Koh Samui to Azure, to supervise cleaning, laundry, maintenance, etc. and to advise you on tourism facilities and services;
  • the costs of electricity & water, internet & satellite services, cleaning & gardening supplies, and  taxes;
  • the use of our linen, crockery, utensils, appliances, books, CD/DVDs, etc. (books may be exchanged with equivalent volumes, except those marked “No Exchange” please);
  • an initial supply of toiletries and groceries (but items consumed should be replenished before your departure, or an approximate cash amount given to our representative for restocking by her); and
  • the free use of a jeep and a scooter (please see below re insurance liability for these vehicles).

Initial Deposit
An initial deposit of 40% of the rental cost is required to confirm a booking.  If funds are not received within 5 banking days after you confirm the booking, your reservation may not be held for you.  For bookings of less than a week, or bookings made within 30 days of arrival, full payment is required at the time of reservation.

Balance Payment
Payment of the 60% balance should be received 30 days before the arrival date.  Should Azure not receive the balance in time, we reserve the right to cancel the booking and apply the cancellation charge below.

Cancellation
You may cancel your reservation at any time by notifying us by email. The following cancellation terms apply: * more than 30 days before arrival: forfeiture of the 40% deposit (or 20% if we can find replacement guests for the period);  * less than 30 days before arrival: total cost paid (or 50% thereof if we can find replacements).

Alteration or Cancellation by Azure
In the unlikely event that Azure has to make any changes to confirmed bookings, we will advise you at the earliest possible date. If the apartment has been damaged or otherwise rendered unusable for any reason beyond our control, so that we are unable to accommodate your party, Azure reserves the right to cancel the reservation. However, we shall endeavor to locate an alternative, equivalent property for the required period.  If this is not possible, or you do not wish to be transferred, we will cancel the booking and refund you in full.
Azure shall not be liable for any further obligations or claims by the client.

Arrival & Departure Times
Check-in is after 15.00, and checkout is prior to 11.00, unless otherwise agreed.

Registered Guests & Pets
Only  persons stipulated on the booking form may reside at the property.  Please notify us of any changes in advance.  The number of guests must not exceed the maximum capacity, except in the case of infants (under two years old), or unless specifically agreed.  Should Azure's representative find regular overnight guests exceeding those on the booking form, they will be subject to a per-person, per-day surcharge and/or asked to vacate the premises.  No camping is permitted in the CD&P Unique compound (except “sleep-outs” on the roof).  Azure regrets that no pets are allowed without prior agreement.

Security Deposit
A security deposit of 1 night's rental is payable to the hospitality executive when you check-in. This is to cover the costs of damage or breakages that your party may cause during the rental period, which must be reported immediately they occur.  This amount, less any such costs, will be returned to you at the time of departure.

Travel & Health Insurance
Your entire party should be covered by comprehensive travel insurance (including cancellation, flight delays, loss and damage to baggage and other property) and health insurance (including local treatment, evacuation and repatriation coverage).  As deposits and rental payments may not be fully refundable after reservations are confirmed, your cover should include for money paid to Azure in case you might have to cancel your journey.

Vehicle Insurance
Vehicles owned by the lessor and lent to you are insured for use by duly licensed drivers, but you may be liable for “at fault” damages.  Please give copies of all drivers' licenses by email in advance and show originals to our representative on arrival.  If we provide you with vehicles supplied by third-party renters, you will sign the rental agreements and be liable thereunder (other than for the basic rental charge).

Liability Release
Under no circumstances shall Azure, its owner or our staff be responsible for any loss, expense, damage, claim or injury either directly or indirectly, consequential or otherwise during your stay.  This includes any accidents related to the use of our facilities or to third-party services such as but not limited to watercraft or vehicle rental.  By making the booking you agree that this requirement will be fully honored.

Conduct & Behaviour
The person making the reservation is held responsible for the appropriate behavior of the guests. Should any member of the party not behave in such a manner, the Azure representative may at their absolute discretion ask the offending guest(s) to vacate forthwith.  Firearms, other deadly weapons, pyrotechnics, and those drugs or gambling activities prohibited under Thai law are not permitted on the premises.

Valuables
Any valuables kept at the property are at the guests' own risk. Azure's owners and staff may not be held responsible for their loss or damage.  But if required, with 10 days' advance notice, we shall try to arrange a safe-deposit facility for you with Siam Commercial Bank, Chaweng/BoPhut.

Linen, Towels and Other Laundry
Linen and towels are included in the rental and are normally changed twice a week.  More frequent changes  may incur extra charges.   Other laundry services are available close-by for a small  charge (about $1/kg).

Telecommunications
Guests may NOT use the landline to make long-distance calls (except by prior financial arrangement with our representative).  But we offer you internet access to Skype through your laptop, and we can provide you with a local sim to enable pre-paid calls if required: just ask Khun Oh.

Due Care and Safety
As part of this agreement, guests are required to take due care, especially of children playing in the gardens, near or in the entrance, on the road, in or around the swimming pool, or on the roof.  Guests should not enter the building wet as the floors can be slippery.  Damage or injury arising shall not be the responsibility of Azure.  Handling of furniture, crockery and other artifacts shall be done with maximum care;  the staff is available to help if necessary.

Applicable Law
These conditions and any contract to which they apply are governed in all respects by the applicable Thai law; the Thai courts shall have sole jurisdiction on any claim or dispute arising out of or connected with them.
